Amendments to regulations and guidelines 5/2019 related to the Capital Requirements Regulation

The FIN-FSA has made amendments to its regulations and guidelines 5/2019 related to the EU Capital Requirements Regulation (CRR). The need to amend the regulations and guidelines has arisen particularly from the amendments to the CRR (Regulation (EU) 2024/1623 of the European Parliament and of the Council, CRR3) and from the guidelines of the European Central Bank ((EU) 2025/1521)1.

The amendments implement nationally an article of the ECB Guideline concerning transitional arrangements for credit ratings issued by external credit rating agencies on institutions. In addition, the necessary amendments arising from the entry into force of CRR3 have been made to the regulations and guidelines, inter alia in the chapters concerning the standardised approach to credit risk, the internal ratings-based approach and operational risk.

A new subsection has been added to the regulations and guidelines concerning exposures related to land acquisition, development and construction (ADC exposures). The subsection provides a clarifying interpretation on the capital treatment of the financing of properties covered by the RS system. The interpretation is based on the EBA Guidelines on ADC exposures to residential property under Article 126a of Regulation (EU) No 575/2013 (EBA/GL/2025/03)2.

As a result of the Act on Specialised Financing Activities and Their Organisation (1458/2025), which entered into force at the beginning of the year, the regulations and guidelines have been supplemented with a more detailed FIN-FSA interpretation concerning the capital treatment of receivables from or guaranteed by Finnvera Plc.

Other technical amendments have also been made to the regulations and guidelines. Among others, references to EBA Guidelines and FIN-FSA recommendations on their application have been removed from the regulations and guidelines as they are no longer necessary. The EBA Guidelines will continue to be available on the FIN-FSA website in the Regulation section on the page Guidelines of the European Supervisory Authorities, which lists the EBA, EIOPA and ESMA guidelines that supervised entities and other financial market participants must seek to comply with.

Entry into Force of the Regulations and Guidelines

The amendments to the regulations and guidelines are applicable as of 7 September 2026.
