European Securities and Markets Authority guidelines on the transfer of data between trade repositories - applicable from 29.4.2024
ESMA has issued Guidelines (ESMA74-362-2351) on the transfer of data between trade repositories under EMIR and SFTR.
The Financial Supervisory Authority has confirmed it will comply with the Guidelines.
In accordance with Article 16(3) of the ESMA Regulation1, financial market participants shall make every effort to comply with ESMA’s guidelines.
Application
The ESMA Guidelines will apply in relation to:
- the reporting without duplication of details on derivatives
- the procedures for portability between trade repositories
- the transfer of derivatives between trade repositories
- the record-keeping of details of derivatives in trade repositories
- he application of regulatory technical standards for the registration of trade repositories.
Date of application
The guidelines will apply from 29 April 2024.
