Crypto-asset service providers in Finland must be authorised in the EU
On 23 June, the European Securities and Markets Authority (ESMA) issued a statement regarding unauthorised crypto-asset service providers in Europe.
Unlike in Finland, in some other European countries it has been permitted to provide crypto-asset services without authorisation until 30 June 2026, within the framework of a transitional period. As of 1 July 2026, it is not permitted to provide crypto-asset services without authorisation in the European Union or the European Economic Area.
Not all entities providing crypto-asset services in Europe are authorised. As such entities must wind down their activities, clients may face restrictions in using services. The Financial Supervisory Authority (FIN-FSA) recommends that clients check the ESMA register as to whether a service provider is authorised. If this is not the case, the FIN-FSA recommends transferring the customer relationship to an authorised crypto-asset service provider that provides services in Finland.
Some unauthorised crypto-asset service providers may be located in third countries. The FIN-FSA reminds investors that using such services from Finland is only possible on the client’s own initiative. Even if a client has used the services of an unauthorised crypto-asset service provider on their own initiative, the service provider no longer has the right to market other services or new crypto-assets to the client.
